TERMS AND CONDITIONS – LAPTOPGARAGE TECHNOLOGIES

Welcome to LaptopGarage Technologies.
These Terms and Conditions (“Terms”) govern access to and use of the LaptopGarage Technologies website, online store, physical store, quotations, orders, purchases, deliveries, repairs, warranty services, returns, exchanges and refunds.
“LaptopGarage Technologies“, “LaptopGarage”, “we“, “us” and “our” refer to LaptopGarage Technologies. “Customer”, “Client”, “you” and “your” refer to the person or entity purchasing or seeking to purchase products or services from us.
By placing an order, making a purchase, accepting a quotation, making payment, receiving a product, or otherwise using our services, you acknowledge that you have had a reasonable opportunity to review these Terms and the policies applicable to your transaction and agree to be bound by them, subject to applicable law.
If you do not agree to these Terms, you should not place an order or use our services.
Nothing in these Terms is intended to exclude, restrict or limit any consumer right, statutory warranty, remedy, liability or protection that cannot lawfully be excluded or limited under the laws of Kenya.
These Terms are principally governed by the laws of the Republic of Kenya.
- Where applicable, the transaction may also be subject to the Consumer Protection Act, 2012, the Competition Act, 2010, the Sale of Goods Act, the Data Protection Act, 2019, applicable tax legislation, electronic commerce requirements and other applicable Kenyan legislation.
For transactions involving customers outside Kenya, these Terms apply to the maximum extent permitted by the applicable law of the relevant jurisdiction. Mandatory consumer, tax or other legal protections that cannot lawfully be excluded shall continue to apply.
LaptopGarage Technologies sells technology products including, but not limited to:
- Brand-new laptops and computers;
- Certified refurbished laptops and computers;
- Ex-UK and other pre-owned devices;
- Mobile phones and tablets;
- Monitors and displays;
- Chargers, batteries and accessories;
- Networking equipment;
- Storage devices;
- CCTV and related equipment; and
- Other technology products and services offered from time to time.
Products may differ in condition, specifications, cosmetic appearance, included accessories and warranty coverage depending on the individual product listing.
The applicable product listing, quotation or invoice should therefore be read together with these Terms.
4.1 Brand-New Products
A product described as “Brand New” is represented as new and unused, subject to any specific disclosure made on the applicable product listing.
Where a product is described as open-box, display stock, resealed, or otherwise not factory-sealed, that condition will be disclosed where applicable.
4.2 Certified Refurbished Products
“Certified Refurbished” means a pre-owned or previously used device that has undergone LaptopGarage Technologies’ internal inspection, diagnostic testing, cleaning and functional verification process.
Unless expressly stated otherwise, “Certified Refurbished” does not mean manufacturer-certified refurbished.
4.3 Ex-UK and Pre-Owned Products
Ex-UK and pre-owned products may exhibit reasonable signs of prior use, including minor cosmetic marks, scratches, dents or other wear consistent with their disclosed condition.
Where a product has a stated cosmetic grade or condition description, that description forms part of the product representation.
4.4 Cosmetic Variations
Photographs may be representative images unless the product listing expressly states that the image depicts the exact unit being sold.
Minor cosmetic differences between an image and the actual product shall not constitute a defect where the difference is consistent with the disclosed product condition.
Material differences in model, specification, configuration or condition will be addressed in accordance with applicable law and our Return Policy.
We take reasonable steps to ensure that product descriptions, specifications, photographs and pricing are accurate.
However:
- manufacturers may change specifications without notice;
- product images may be representative;
- refurbished products may vary cosmetically;
- stock may vary between configurations;
- manufacturer specifications may change;
- compatibility may depend on third-party hardware or software; and
- certain specifications may vary by region or configuration.
Where a product listing contains a specific specification that materially differs from the product supplied, the matter will be handled in accordance with applicable law and the relevant Return, Exchange or Warranty Policy.
Customers purchasing for a specific technical requirement should confirm compatibility with our sales team before purchase.
LaptopGarage Technologies may perform inspection and diagnostic testing before dispatch, particularly for refurbished, Ex-UK and pre-owned products.
Depending on the product, testing may include:
- display;
- keyboard;
- touchpad;
- ports;
- charging;
- battery;
- storage;
- memory;
- processor performance;
- Wi-Fi;
- Bluetooth;
- camera;
- speakers;
- microphone;
- biometric functions;
- operating system functionality; and
- other applicable hardware diagnostics.
The extent of testing may vary by product category.
Testing does not constitute a guarantee that a device will remain free from defects for the entire period of ownership.
Submitting an order through our website, WhatsApp, telephone, social media or other communication channel constitutes a request to purchase the relevant product.
An order becomes accepted when LaptopGarage Technologies confirms acceptance, issues an applicable order confirmation or quotation acceptance, receives payment and/or dispatches the product, subject to the circumstances of the transaction.
We reserve the right to decline or cancel an order where reasonably necessary because of:
- stock discrepancies;
- genuine pricing or system errors;
- payment verification problems;
- suspected fraudulent activity;
- inability to verify the customer or transaction;
- incorrect product information;
- supplier or manufacturer availability issues;
- regulatory or legal restrictions; or
- other legitimate operational circumstances.
Where payment has already been received for an order that we cancel, any applicable refund will be handled in accordance with our Refund Policy and applicable law.
Prices are displayed in Kenyan Shillings (KES) unless otherwise stated.
Prices, discounts and promotions may change from time to time.
A price displayed due to an obvious typographical, technical or system error does not automatically create an obligation to supply the product at the erroneous price where the error is reasonably identifiable before fulfilment.
Where a genuine pricing error affects an order, LaptopGarage Technologies may:
- Contact the customer and offer the product at the correct price; or
- Cancel the affected order and refund any amount paid for that affected order.
This clause does not permit arbitrary changes to an agreed transaction or override any mandatory consumer protection.
Applicable taxes, VAT treatment and invoicing requirements will be determined in accordance with Kenyan tax law and the nature of the transaction.
Where a price is expressly stated as VAT-inclusive or VAT-exclusive, that description will apply.
Customers requiring business or tax documentation should provide accurate billing information before or at the time of purchase.
Where applicable, LaptopGarage Technologies will issue the relevant tax invoice or eTIMS documentation in accordance with applicable Kenya Revenue Authority requirements.
Corporate customers should ensure that their company details, PIN and other required information are accurate before invoicing.
We may accept payment through methods including:
- M-Pesa;
- bank transfer;
- credit cards;
- debit cards;
- cash, where available;
- approved installment arrangements; and
- other payment methods expressly offered by LaptopGarage Technologies.
An order may be subject to payment verification before dispatch.
LaptopGarage Technologies may delay or suspend fulfilment where:
- payment has not been successfully received;
- a payment is reversed;
- a transaction is disputed;
- a card or payment account appears unauthorized;
- there is evidence of fraudulent activity; or
- additional verification is reasonably required.
Where a payment is reversed, disputed or subjected to a chargeback, LaptopGarage Technologies may investigate the transaction and request reasonable documentation from the customer.
Where appropriate, fulfilment or related services may be suspended while a payment dispute is investigated, subject to applicable law.
Customers must not initiate a fraudulent or misleading payment reversal after receiving and retaining goods or services.
Nothing in this section limits a customer’s lawful right to dispute an unauthorized transaction or exercise a statutory remedy.
Installment, credit or financing purchases may be subject to additional terms communicated at the time of purchase.
Where a third-party financing or payment provider is involved, that provider’s applicable agreement may also govern the financing arrangement.
A customer must continue meeting agreed payment obligations unless the applicable agreement or law provides otherwise.
Return, exchange, warranty and refund rights relating to an installment purchase remain subject to applicable law and the relevant LaptopGarage policy.
Promotional prices, vouchers and discounts are valid only for the period and products specified in the relevant promotion.
Unless expressly stated otherwise:
- promotions cannot be applied retrospectively;
- promotions cannot be exchanged for cash;
- multiple promotions cannot be combined;
- discounts may be limited to specified stock; and
- promotional products remain subject to the applicable Warranty, Return, Exchange and Refund Policies.
A promotion will not be used to remove or reduce a consumer right that cannot legally be excluded.
LaptopGarage Technologies provides product warranties ranging from the period expressly stated on the applicable product listing, invoice, warranty documentation or quotation.
Warranty coverage generally applies to verified defects arising during normal and intended use, subject to the applicable Warranty Policy.
Warranty coverage may exclude, where applicable:
- accidental damage;
- liquid or moisture damage;
- physical abuse;
- impact damage;
- unauthorized repair;
- unauthorized modification;
- component substitution;
- tampering;
- misuse;
- electrical or power-related damage;
- malware or software-related problems;
- consumable deterioration; and
- other exclusions expressly stated in the applicable Warranty Policy.
A warranty exclusion will be applied to the extent that the relevant condition caused or materially contributed to the reported fault.
A warranty does not automatically become invalid merely because a customer makes a change to a device unless that change is relevant to the reported fault or otherwise falls within a lawful exclusion.

Returns are governed by the LaptopGarage Technologies Return Policy.
Customers should notify LaptopGarage Technologies within the period specified in the Return Policy where they identify:
- apparent transit damage;
- an incorrect product;
- an apparent out-of-box defect; or
- another circumstance giving rise to an approved return.
The applicable notification period is an administrative procedure and does not extinguish any statutory or warranty right that cannot lawfully be excluded.
For operational, security and inventory-control purposes, customers should obtain a Return Merchandise Authorization (“RMA”) before sending a product back.
An unauthorized return may be held pending identification and verification.
Serial numbers, IMEI numbers, service tags, warranty labels and other identifying information may be checked against our sales records.
Products showing evidence of component substitution, altered identifiers, deliberate damage, unauthorised modification or fraud may be rejected subject to applicable law.

Approved exchanges are governed by the LaptopGarage Technologies Exchange Policy.
Where an exchange is appropriate, LaptopGarage Technologies may, depending on the circumstances and applicable law:
- repair the original product;
- replace it with the same model;
- provide a substantially similar product;
- provide an equivalent product; or
- offer an alternative product where agreed with the customer.
Where a customer voluntarily chooses a higher-value product, the applicable price difference will ordinarily be payable by the customer.
Where the replacement is a lower-value product by agreement, any applicable price adjustment will be addressed in accordance with the Exchange and Refund Policies.
The LaptopGarage Technologies Refund Policy governs refunds.
A refund is not automatically available merely because a customer changes their mind about a correctly supplied, functional product.
Where a product is defective, the available remedy will depend on the nature of the defect, the applicable warranty, the circumstances of the transaction, the feasibility of repair or replacement, and applicable Kenyan law.
Where a refund is legally required or approved under the applicable policy, it will be processed using the appropriate payment method and within the applicable processing period.
Nothing in these Terms gives LaptopGarage Technologies a contractual right to refuse a remedy that applicable law requires us to provide.
Where a return is approved, the customer should return the product together with all items supplied with the purchase, including where applicable:
- chargers;
- cables;
- manuals;
- packaging;
- accessories;
- promotional items;
- free gifts; and
- other components supplied with the product.
The condition of returned products may be inspected before an exchange or refund is finalized.
Where a product has been damaged, altered, misused or materially changed after delivery, the available remedy may be affected to the extent permitted by law and the applicable policy.
Normal inspection, testing and reasonable use necessary to identify a defect will not by itself constitute misuse.
Returned products may undergo technical and physical inspection.
Inspection may include:
- verification of the serial number or IMEI;
- verification of the original configuration;
- physical inspection;
- diagnostic testing;
- inspection for liquid or physical damage;
- verification of warranty labels;
- examination for unauthorized modification;
- testing of reported faults; and
- comparison against the condition documented at dispatch.
Where reasonably necessary, LaptopGarage Technologies may retain the product for the period reasonably required to complete testing.
Where a claim is rejected, the customer will be informed of the principal reason for the rejection.
Customers are responsible for backing up their data before submitting a device for return, warranty service, repair, exchange or inspection.
Customers should remove:
- personal files;
- passwords;
- Microsoft accounts;
- Apple IDs;
- Google accounts;
- device-management profiles;
- Find My Device / Find My iPhone locks; and
- other security controls that prevent lawful inspection or testing.
Where a device remains locked and cannot reasonably be tested, LaptopGarage Technologies may delay processing until the device can be accessed.
Customers remain responsible for ensuring that they have the necessary rights and permissions to provide a device to us for inspection or repair.
To the maximum extent permitted by applicable law, LaptopGarage Technologies shall not be responsible for loss of customer data, software, applications, licenses or files arising during reasonable inspection, repair, restoration, replacement or refurbishment.
Customers must maintain independent backups of important information.
Where data recovery is specifically requested, it may constitute a separate service subject to additional terms and charges.
For health, safety and technical reasons, LaptopGarage Technologies may require a device to be cleaned before inspection where it is excessively dirty, contaminated or presents a reasonable health or safety concern.
Where cleaning is reasonably necessary because of the customer’s condition of the device, the customer may be responsible for the associated reasonable cost where permitted by the applicable policy and law.
LaptopGarage Technologies may deliver within Kenya and, where offered, to other East African destinations.
Delivery estimates are provided for guidance and are not guaranteed deadlines unless expressly agreed otherwise in writing.
Indicative delivery periods may vary depending on:
- destination;
- stock availability;
- payment verification;
- courier schedules;
- public holidays;
- weather;
- security conditions;
- remote locations;
- customer-provided information;
- customs or regulatory requirements; and
- circumstances beyond our reasonable control.
Customers are responsible for providing accurate delivery information.
Customers are encouraged to inspect delivered packages as soon as reasonably practicable.
Where there is visible courier damage, customers should document the condition with photographs or video before opening the package where reasonably possible and notify LaptopGarage Technologies within the applicable period in the Return Policy.
Failure to immediately document visible damage will not automatically determine the customer’s legal rights, but may affect our ability to establish whether damage occurred before or after delivery.
Where a customer independently arranges return shipping, responsibility for loss or damage occurring during transit ordinarily remains with the customer until the product is received by and acknowledged by LaptopGarage Technologies, subject to applicable law.
Customers are strongly encouraged to:
- use a reputable courier;
- retain proof of dispatch;
- package the device securely;
- obtain tracking information; and
- insure high-value shipments where appropriate.
Where LaptopGarage Technologies arranges the return shipment, the applicable shipping arrangements will be communicated to the customer.
Unless otherwise agreed in writing or required by applicable law, ownership of a product passes to the customer upon full payment and completion of delivery.
Risk of accidental loss or damage generally passes upon delivery to the customer or the customer’s authorized recipient.
For installment, credit or financing arrangements, ownership and risk may be governed by the applicable financing agreement.
Nothing in this clause overrides mandatory provisions of applicable law.
LaptopGarage Technologies takes product fraud seriously.
We may investigate claims where there is reasonable evidence of:
- component swapping;
- replacement of original parts with unauthorized parts;
- altered or removed serial numbers;
- IMEI manipulation;
- warranty-label tampering;
- deliberate damage;
- fraudulent return claims;
- false payment disputes;
- unauthorized repair;
- device sabotage;
- theft;
- identity or payment fraud; or
- repeated abuse of our return or warranty processes.
Where inspection establishes that a particular fault was caused or materially contributed to by such conduct, LaptopGarage Technologies may decline the relevant warranty, return or exchange remedy to the extent permitted by law.
We may also suspend or refuse future commercial transactions where reasonably necessary to prevent fraud, abuse or unlawful activity, subject to applicable law.
LaptopGarage Technologies does not guarantee compatibility between a product and every third-party software application, operating system configuration, peripheral or service.
Customers should verify specific technical requirements before purchase where compatibility is critical.
Where a customer specifically communicates a required purpose or compatibility requirement to our sales team and relies upon our technical recommendation, the transaction will be assessed in accordance with applicable law and the representations actually made.
Customers are responsible for ensuring that information supplied to LaptopGarage Technologies is accurate and complete.
This includes:
- name;
- telephone number;
- email address;
- delivery address;
- billing information;
- company information;
- KRA PIN where required;
- product requirements; and
- other information reasonably necessary to process the transaction.
LaptopGarage Technologies is not responsible for delays or additional costs caused directly by materially incorrect customer-provided information.
LaptopGarage Technologies processes personal data in accordance with the Kenya Data Protection Act, 2019 and applicable regulations.
We do not sell customer personal data.
Personal information may, where reasonably necessary and lawful, be shared with service providers such as:
- payment processors;
- banks;
- courier and delivery providers;
- technology and hosting providers;
- communication providers;
- accounting or professional service providers; and
- government or regulatory authorities where legally required.
The purposes, legal bases, retention periods, data-subject rights, marketing practices and other data-processing matters are explained in our Privacy Policy.
Direct marketing will be conducted in accordance with applicable data-protection requirements, including applicable objection and opt-out rights.
Where permitted by law, LaptopGarage Technologies may communicate with customers about products, services, promotions and related offers.
Customers may opt out of direct marketing communications using the unsubscribe or opt-out mechanism provided or by contacting us through the channels specified in our Privacy Policy.
Opting out of marketing communications does not prevent essential transactional communications such as order confirmations, invoices, delivery notifications, warranty communications or security notices.
The LaptopGarage Technologies name, logo, website content, graphics, photographs, text, product descriptions and other original materials used on our website remain the property of LaptopGarage Technologies or their respective licensors unless otherwise stated.
Customers may not reproduce, modify, distribute or commercially exploit our original website content without prior written permission.
Third-party trademarks and product names remain the property of their respective owners.
We seek to maintain accurate and reliable website services but do not guarantee uninterrupted availability.
Website content may occasionally contain:
- technical errors;
- typographical errors;
- outdated information;
- stock discrepancies;
- pricing errors; or
- temporary service interruptions.
We may correct errors and update website information without notice, subject to applicable law and existing contractual obligations.
To the maximum extent permitted by Kenyan law, LaptopGarage Technologies shall not be liable for indirect, incidental, special or consequential loss arising from the use of a product or service.
This may include, where legally excludable:
- loss of anticipated profits;
- loss of business opportunity;
- loss of goodwill;
- loss arising from third-party software;
- loss resulting from customer data that was not backed up; or
- business interruption.
However, nothing in these Terms excludes or limits:
- liability that cannot lawfully be excluded or limited;
- statutory consumer rights;
- remedies that applicable law requires us to provide; or
- liability arising from conduct for which exclusion or limitation is prohibited by law.
Nothing in these Terms, or in any Warranty, Return, Exchange, Refund or Shipping Policy, is intended to remove or reduce any mandatory right or remedy available to a consumer under Kenyan law.
Where a provision of these Terms conflicts with a mandatory legal requirement, the mandatory legal requirement shall prevail to the extent of the conflict.
This provision does not prevent LaptopGarage Technologies from applying reasonable contractual procedures, inspection requirements, warranty exclusions or commercial conditions that are otherwise lawful.
The following documents may form part of a customer’s transaction:
- applicable mandatory law;
- an expressly agreed written quotation or transaction-specific agreement;
- the applicable invoice or order confirmation;
- the applicable Warranty Policy;
- the applicable Return Policy;
- the applicable Exchange Policy;
- the applicable Refund Policy;
- the applicable Shipping and Delivery Policy;
- these Terms and Conditions; and
- general website or promotional information.
Where two documents conflict, the more specific transaction document will ordinarily govern the relevant matter, subject always to mandatory law.
LaptopGarage Technologies may update these Terms from time to time.
The version applicable to a transaction will ordinarily be the version made available to the customer at the time the relevant order is accepted.
Changes made after an order has been accepted will not retrospectively alter the contractual terms of that completed transaction unless:
- the customer agrees to the change; or
- the change is required by law.
The current version will be made available on our website.
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be modified or severed only to the minimum extent necessary.
The remaining provisions shall continue in full force and effect to the extent permitted by law.
Failure by LaptopGarage Technologies to enforce any provision of these Terms on one occasion does not constitute a waiver of our right to enforce that provision in the future.
LaptopGarage Technologies shall not be responsible for delays or failures caused by circumstances beyond our reasonable control, including where applicable:
- natural disasters;
- severe weather;
- civil disturbances;
- strikes;
- transport disruptions;
- major technology or telecommunications failures;
- government restrictions;
- regulatory actions;
- security incidents;
- supplier failures;
- courier disruptions; or
- other circumstances that could not reasonably have been prevented or overcome.
This clause does not remove any consumer remedy that mandatory law requires us to provide.
Customers are encouraged to first contact LaptopGarage Technologies regarding any complaint or dispute.
We will make reasonable efforts to investigate and resolve complaints through our internal customer-support process.
Customers should provide sufficient information to enable investigation, including where applicable:
- order number;
- invoice or receipt;
- product serial number;
- description of the issue;
- photographs or videos;
- relevant correspondence; and
- requested remedy.
Our internal complaint process does not prevent a customer from exercising any lawful right to seek assistance from a competent regulator, tribunal or court.
The parties should first attempt to resolve disputes through good-faith communication.
Where a dispute cannot be resolved internally, either party may pursue any remedy available under applicable Kenyan law.
These Terms shall not be interpreted as requiring a consumer to waive a statutory right to bring a claim before a competent court, tribunal, regulator or other legally authorized body.
Subject to applicable law, courts of competent jurisdiction in Kenya may determine disputes arising from transactions governed by these Terms.
These Terms, together with the applicable product listing, quotation, invoice, order confirmation, Warranty Policy, Return Policy, Exchange Policy, Refund Policy, Shipping Policy and Privacy Policy incorporated into the relevant transaction, constitute the contractual framework governing the customer’s transaction with LaptopGarage Technologies.
Where a transaction-specific written agreement expressly modifies these Terms, the transaction-specific agreement shall apply to the extent of the agreed modification, subject to mandatory law.
By placing an order, the customer represents that they have the legal capacity and authority necessary to enter into the transaction.
Where a person purchases on behalf of a company or other organization, that person represents that they are authorized to act on behalf of that organization.

- they have had an opportunity to review these Terms;
- product condition and specifications should be reviewed before purchase;
- the applicable warranty period should be checked before purchase;
- refurbished and Ex-UK products may have reasonable cosmetic signs of prior use;
- customers should maintain backups of important data;
- return, exchange and refund procedures are governed by the applicable policies; and
- these Terms operate subject to mandatory rights and protections under applicable Kenyan law.
LaptopGarage Technologies shall not be responsible for delays or failures caused by circumstances beyond our reasonable control, including where applicable:
- natural disasters;
- severe weather;
- civil disturbances;
- strikes;
- transport disruptions;
- major technology or telecommunications failures;
- government restrictions;
- regulatory actions;
- security incidents;
- supplier failures;
- courier disruptions; or
- other circumstances that could not reasonably have been prevented or overcome.
This clause does not remove any consumer remedy that mandatory law requires us to provide.
